PROJECT 8

Is a community project where users of the Impossible I-1 instant camera submit a photo to Impossible Camera GmbH, Potsdamer Strasse 87, 10785 Berlin (“Impossible”). The submitted photo will be shown in public physical and online gallery exhibitions and finally swapped between the participants of Project 8 (“Participants”). By submitting an original photo made with the Impossible I-1 (“Photo”) to Impossible, using the prepaid envelope or indicating otherwise that you want to take part in Project 8, you agree to and accept the terms and conditions set out below:

TRANSFER OF OWNERSHIP

You transfer the ownership of the Photo to Impossible without consideration. Transfer of risk shall occur with receipt of the Photo by Impossible. You are aware that Impossible will not accept a Photo that promotes racist, sexist, unlawful or discriminatory content or propaganda.

LICENSE

You irrevocably grant to Impossible the worldwide, non-exclusive, royalty-free, transferable and sub-licensable right to use the Photo as follows: (i) present the Photo to the public in physical or online gallery exhibitions, (ii) modify and reproduce the Photo (including, without limitation, scanning, copying, digitalizing, resizing, cropping) and (iii) use the Photo in presentations, on social media, on websites or for press coverage. You waive and release any right that you may have to inspect and approve the finished product or copy that may be used in connection with the Photo and/or the use to which it may be applied. You waive any moral rights in the Photo in favor of Impossible, including the right to restrain or claim damages for any distortion, defacement, or other modification of the Photo or any part thereof. Where feasible, Impossible will show your full name as stated on the return slip as credit name.

WARRANTY

You warrant that (i) you are the photographer and sole owner of the Photo and own all rights, title and interest in and to the Photo, (ii) the use of the Photo as set out herein does not violate, misappropriate or infringe on the rights of any third party (including, without limitation, privacy rights, publicity rights, copyrights, trademark and/or other intellectual property rights), (iii) the personal data you gave to Impossible is correct, (iv) the Photo is made with the Impossible I-1 and (v) you have the legal right and capacity to enter into these terms.

SWAP

You are aware that the ownership of the Photo will be transferred to a random Participant at the end of Project 8. In return, you will receive a Participant’s photo. You agree that the usage of this photo you receive is limited to the statutory usage rights of an owner of an original photo; no further usage rights are granted.

CLOSING DATE 

The closing date for submission of your Photo to participate in Project 8 is 12 July 2016 (date of dispatch of your Photo).

PERSONAL DATA

You are aware and agree that the personal data you give to Impossible (e.g. full name, address, email) (“Data”) will be stored and processed. You can choose not to provide certain data but then you might not be able to take advantage of many of the features of Project 8. We use the Data for such purposes as responding to your requests, setting up a customer database, communicating with you, sending you a Participant’s photo as part of Project 8. The Data will be shared with or transferred to third party servicers only to the extent required to facilitate Project 8 (e.g. logistics servicers). Such third party servicers will use your Data only to perform their obligations as our servicer. You may revoke your consent at any time, although this might affect your participation in Project 8. Please send any notice of cancellation to [email protected] or in writing to Impossible. In the event of cancellation, your Data will be deleted upon receipt of your notice.
